1. Kto appku poskytuje

Appku Turista – sprievodca po horách (ďalej „appka“) poskytuje Dorotty, s. r. o., M. R. Štefánika 1066/6, 018 41 Dubnica nad Váhom, IČO 46 651 951, zapísaná v Obchodnom registri Okresného súdu Trenčín, oddiel: Sro, vložka č. 26160/R (ďalej „my“). Kontakt: info@dorotty.cloud.

Appka je pre iPhone (App Store) a Android (Google Play). Pre appku stiahnutú z App Store platí okrem týchto podmienok aj štandardná licenčná zmluva Apple (Licensed Application End User License Agreement).

2. Na čo appka slúži

Turista pomáha naplánovať túru na Slovensku. K cieľu, ktorý zadáte (vrchol, chata, sedlo), vypočíta v mobile výstupy, okruhy a prechody po sieti značených chodníkov z OpenStreetMap. Pri každej trase ukáže čas, dĺžku, prevýšenie, náročnosť, technické úseky (reťaze, stúpačky, rebríky) a sezónne uzávery národných parkov. Ďalej ukáže počasie a výstrahy SHMÚ na deň túry a ubytovanie v okolí a ponúkne navigáciu v appke Mapy.com alebo vlastnú offline navigáciu. V nástrojoch má kompas, výškomer a „Aký to je kopec“ (mená vrcholov v obraze kamery alebo v 3D obraze krajiny, vypočítané z výškového modelu).

Appku používate bez účtu a bez registrácie.

3. Údaje sú orientačné – bezpečnosť v horách

Turista je pomôcka na plánovanie, nie záruka bezpečnej túry. Čas, náročnosť a počasie sú odhad. Trasy, technické úseky, uzávery a ubytovanie pochádzajú z otvorených zdrojov (najmä OpenStreetMap) a nemusia byť úplné ani aktuálne. Predpoveď počasia nie je istota – búrka v horách môže prísť rýchlo. Preto:

riaďte sa turistickým značením v teréne, návštevnými poriadkami národných parkov a pokynmi Horskej záchrannej služby (HZS),
sezónne uzávery a aktuálne podmienky si pred túrou overte na webe správy národného parku a HZS,
túru plánujte podľa svojich síl, skúseností, výstroja a počasia – či, kedy a kadiaľ pôjdete, rozhodujete vy,
vlastná navigácia závisí od signálu GPS, batérie a mapy stiahnutej do mobilu, preto sa nespoliehajte len na ňu,
kompas, výškomer a Aký to je kopec sú orientačné pomôcky – kompas v mobile býva nepresný (kalibrácia, kov a magnety v okolí), výška z barometra a GPS je odhad a mená vrcholov sú vypočítané z modelu terénu, môžu sa mýliť; na orientáciu sa nespoliehajte len na ne, majte so sebou mapu,
v núdzi volajte 18 300 (HZS) alebo 112.

Turista tiesňové správy neposiela – na to slúži oficiálna appka Horská záchranná služba alebo hovor na 18 300 či 112. Tlačidlá na obrazovke Bezpečnosť len otvoria vytáčanie v telefóne.

4. Nezávislosť

Turista nie je aplikáciou štátu, Slovenského hydrometeorologického ústavu (SHMÚ), Horskej záchrannej služby (HZS), Klubu slovenských turistov (KST), správ národných parkov ani Mapy.com, nezastupuje ich a nie je s nimi spriaznený. Ich názvy uvádzame len vecne, aby bolo jasné, odkiaľ údaje pochádzajú alebo kam odkaz vedie. Ich ochranné známky patria ich vlastníkom a ich logá v appke nepoužívame.

5. Služby a obsah tretích strán

Mapy.com, Google Mapy, weby ubytovacích zariadení, appku Horská záchranná služba a ďalšie weby, na ktoré appka odkazuje, prevádzkujú tretie strany podľa svojich podmienok. Za ich obsah, dostupnosť a fungovanie nezodpovedáme.

Ubytovanie zobrazujeme len informatívne podľa OpenStreetMap. Nie sme sprostredkovateľom ubytovania a za odkazy nedostávame províziu. Nocľah, cenu a sezónu si overte a dohodnite priamo so zariadením. Výstrahy SHMÚ preberáme z MeteoAlarm bez úpravy textu.

6. Údaje a licencie

Trasy, chodníky, body a ubytovanie sú © prispievatelia OpenStreetMap pod licenciou ODbL 1.0. Sieť chodníkov v appke je z nich odvodená databáza – na požiadanie ju poskytneme pod licenciou ODbL (info@dorotty.cloud). Všetky zdroje a licencie sú v appke (Nastavenia → Zdroje a licencie) a na stránke Turista. Chybu v mape alebo v chodníku môžete opraviť priamo v OpenStreetMap alebo nám ju napísať.

7. Cena

Appka je zatiaľ bezplatná, bez reklám a bez nákupov v appke. Niektoré funkcie môžu byť neskôr platené. O zmene vás vopred upozorníme, za nič neplatíte bez vášho súhlasu.

8. Zodpovednosť

Appku poskytujeme tak, ako je, a priebežne ju zlepšujeme. Nezaručujeme, že údaje v appke (trasy, časy, náročnosť, technické úseky, uzávery, počasie, výstrahy a ubytovanie) sú úplné, presné a aktuálne, ani že appka a služby, z ktorých čerpá údaje, budú vždy dostupné. Nezodpovedáme za škodu, ktorá vznikne tým, že sa údaje v appke líšia od skutočnosti, ani za služby a obsah tretích strán podľa bodu 5. Toto obmedzenie platí len v rozsahu, ktorý pripúšťa zákon: nevzťahuje sa na škodu spôsobenú úmyselne alebo z hrubej nedbanlivosti ani na škodu na živote a zdraví a nedotýka sa práv spotrebiteľa, ktorých sa vzdať nemožno.

9. Zmeny a ukončenie

Podmienky môžeme zmeniť, o podstatných zmenách vás upozorníme v appke vopred. Appku môžete kedykoľvek prestať používať a odinštalovať. Appku môžeme meniť alebo jej prevádzku ukončiť; ukončenie oznámime vopred v appke alebo na tejto stránke.

10. Rozhodné právo a spory

Tieto podmienky sa riadia právom Slovenskej republiky; spotrebiteľ tým nestráca ochranu, ktorú mu dávajú predpisy štátu jeho obvyklého pobytu. Ak niečo nefunguje alebo nesúhlasíte s naším postupom, napíšte nám na info@dorotty.cloud, spor sa pokúsime vyriešiť dohodou. Spotrebiteľ sa môže obrátiť aj na alternatívne riešenie sporov (Slovenská obchodná inšpekcia, www.soi.sk). Spory rozhodujú príslušné súdy.

1. Who provides the app

Turista – mountain hiking guide (the “app”) is provided by Dorotty, s. r. o., M. R. Štefánika 1066/6, 018 41 Dubnica nad Váhom, Slovakia, company ID (IČO) 46 651 951, registered in the Commercial Register of the District Court Trenčín, section Sro, file no. 26160/R (“we”). Contact: info@dorotty.cloud.

The app is intended for iPhone (App Store) and Android (Google Play). For the app downloaded from the App Store, Apple’s standard licence agreement (Licensed Application End User License Agreement) also applies in addition to these terms.

2. What the app is for

Turista helps you plan a hike in Slovakia. For a destination you enter (a peak, hut or saddle), it calculates ascents, loops and traverses on the phone along the network of marked trails from OpenStreetMap. For each route it shows the time, distance, elevation gain, difficulty, technical sections (chains, iron rungs, ladders) and the seasonal closures of national parks. It also shows the weather and SHMÚ warnings for the day of the hike and accommodation in the area, and offers navigation in the Mapy.com app or its own offline navigation. Under Tools, it has a compass, an altimeter and “What’s that peak?” (the names of peaks in the camera image or in a 3D image of the landscape, calculated from an elevation model).

You use the app without an account and without registration.

3. The data are indicative – safety in the mountains

Turista is a planning aid, not a guarantee of a safe hike. Time, difficulty and weather are estimates. Routes, technical sections, closures and accommodation come from open sources (mainly OpenStreetMap) and may not be complete or up to date. A weather forecast is not a certainty – a thunderstorm in the mountains can come quickly. Therefore:

follow the trail marking on the ground, the national parks’ visitor rules and the instructions of the Mountain Rescue Service (HZS),
before your hike, check seasonal closures and current conditions on the websites of the national park administration and of HZS,
plan your hike according to your abilities, experience, gear and the weather – you decide whether, when and which way you go,
the app’s own navigation depends on the GPS signal, the battery and the map downloaded to the phone, so do not rely on it alone,
the compass, the altimeter and What’s that peak? are indicative aids – a phone’s compass is often inaccurate (calibration, metal and magnets nearby), the altitude from the barometer and GPS is an estimate, and the names of peaks are calculated from a terrain model and may be wrong; do not rely on them alone for orientation, and carry a map,
in an emergency, call 18 300 (HZS) or 112.

Turista does not send emergency messages – that is what the official Mountain Rescue Service (HZS) app or a call to 18 300 or 112 is for. The buttons on the Safety screen only open the dialler on your phone.

4. Independence

Turista is not an app of the state, the Slovak Hydrometeorological Institute (SHMÚ), the Mountain Rescue Service (HZS), Klub slovenských turistov (KST, the Slovak hiking club), the national park administrations or Mapy.com; it does not represent them and is not affiliated with them. We mention their names only factually, to make clear where data come from or where a link leads. Their trade marks belong to their owners, and we do not use their logos in the app.

5. Third-party services and content

Mapy.com, Google Maps, the websites of accommodation providers, the Mountain Rescue Service (HZS) app and other websites the app links to are operated by third parties under their own terms. We are not responsible for their content, availability or operation.

We show accommodation for information only, based on OpenStreetMap. We are not an accommodation intermediary and receive no commission for the links. Check and arrange your overnight stay, the price and the season directly with the establishment. We take SHMÚ warnings from MeteoAlarm without changing their text.

6. Data and licences

Routes, trails, points and accommodation are © OpenStreetMap contributors under the ODbL 1.0 licence. The trail network in the app is a database derived from them – we will provide it on request under the ODbL licence (info@dorotty.cloud). All sources and licences are listed in the app (Settings → Sources and licences) and on the Turista page. You can correct an error in the map or in a trail directly in OpenStreetMap or write to us about it.

7. Price

For now, the app is free, with no ads and no in-app purchases. Some features may be paid in the future. We will notify you of such a change in advance; you do not pay for anything without your consent.

8. Liability

We provide the app as it is and improve it continuously. We do not guarantee that the data in the app (routes, times, difficulty, technical sections, closures, weather, warnings and accommodation) are complete, accurate and up to date, or that the app and the services from which it draws data will always be available. We are not liable for damage arising from the data in the app differing from reality, nor for third-party services and content under section 5. This limitation applies only to the extent permitted by law: it does not apply to damage caused intentionally or through gross negligence or to damage to life or health, and it does not affect consumer rights that cannot be waived.

9. Changes and termination

We may change these terms; we will notify you of material changes in advance in the app. You may stop using the app and uninstall it at any time. We may change the app or discontinue its operation; we will announce discontinuation in advance in the app or on this page.

10. Governing law and disputes

These terms are governed by the law of the Slovak Republic; this does not deprive a consumer of the protection given to them by the law of the country of their habitual residence. If something does not work or you disagree with how we have proceeded, write to us at info@dorotty.cloud and we will try to resolve the dispute by agreement. A consumer may also turn to alternative dispute resolution (Slovak Trade Inspection, www.soi.sk). Disputes are decided by the competent courts.
